RUNNING EVENT - ADULT ASSUMPTION OF RISK, RELEASE OF LIABILITY AND ACKNOWLEDGMENT In consideration of Kingston Road Runners Association (KRRA)-Limestone Race Weekend (LRW) accepting my entry in this running event (“Event”), I, the below undersigned, intending to be legally bound, for myself, my heirs, my executors and administrators, agree as follows: AS A CONDITION of my participation in this Event, I ASSUME ALL RISK of personal injury, death, or property loss resulting from any cause whatsoever, including, but not limited to, the negligence, gross negligence, breach of contract or breach of statutory duty of care, on the part of KRRA-LRW, it’s volunteers, organizers, contractors, associates, representatives, sponsors, successors and assigns (collectively the “KRRA-LRW”). I AGREE that the KRRA-LRW shall NOT BE LIABLE for any such personal injury, death, or property loss as a result of my participation in this Event and I release KRRA-LRW and waive all rights and claims with respect thereto. I AGREE not to sue the KRRA-LRW for any loss, injury, costs or damages of any form or types, howsoever caused or arising, and whether directly or indirectly from my participation in this Event. I AGREE TO INDEMNIFY and to SAVE AND HOLD HARMLESS the KRRA-LRW, and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any of them as a result of my participation in the Event, whether the claim is based on the negligence or gross negligence of the KRRA-LRW or otherwise. I acknowledge that the sport of running and its programs and activities are, by their nature, risky and hazardous and I accept personal responsibility for those risks and hazards. I attest that I am physically fit and sufficiently trained to participate in this Event. I agree to abide by any decision of an Event official concerning participation in the Event. I consent to permit and accept responsibility for emergency treatment in the event of injury or illness. I grant permission to use my name and likeness, and any record of this event in which I may appear for any legitimate purpose. I agree that any photographs, videos or recorded images taken of me by KRRA-LRW or its sponsors before, during or after the Event shall remain the property of KRRA-LRW and KRRA-LRW will have the right to use, in any form and manner of media, such photographs, videos and recordings without remuneration, compensation or other obligation for the purpose of marketing, advertising and promotion. I grant permission to use my personal information, including name, event results and age category during the Event, and further consent to the disclosure of the personal contact information collected during entry or registration to the Event to official partners of KRRA-LRW for the purpose of providing contracted services, such as photography, video and Itab. I agree and acknowledge there will be no refund of any money paid to KRRA-LRW under any circumstances, including, but not limited to, if the Event cannot be held or is rescheduled for any reason, or if I am unable to attend the Event, and all promotions and special registrations are non-transferrable and non-refundable, unless otherwise noted. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM GIVING UP CERTAIN SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. RUNNING EVENT - MINOR FOR PARTICIPANTS OF MINOR AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION) ACKNOWLEDGMENT BY PARENT/GUARDIAN, ASSUMPTION OF RISK AND RELEASE OF LIABILITY I am the parent/guardian of the minor participant, having full legal responsibility for decisions regarding my minor child/ward (hereinafter “Minor Child”). I am familiar with and accept, on behalf of myself and my Minor Child, that there is the risk of serious injury and death in participation of running and in competitive running in particular. I have satisfied myself and believe that my Minor Child is physically, emotionally and mentally able to participate in this Running Event (hereinafter “the Event”). I understand and will instruct my Minor Child that all applicable rules for participation must be followed. I consent to permit and accept responsibility for emergency treatment in the event of injury or illness to my Minor Child. I grant permission to use my Minor Child’s name and likeness, and any record of this event in which my Minor Child may appear for any legitimate purpose. We AGREE that the KRRA-LRW shall NOT BE LIABLE for any such personal injury, death, or property loss as a result of my Minor Child’s participation in the Event and we release KRRA-LRW and WAIVE ALL OUR RIGHTS and CLAIMS with respect thereto. We AGREE not to sue the KRRA-LRW for any loss, injury, costs or damages of any form or types, howsoever caused or arising, and whether directly or indirectly from my Minor Child’s participation in the Event.
